RENTAL AGREEMENT
This Lease Agreement is made and executed on the 28 July 2026, by and between:
The Lessor, residing at __________, hereinafter referred to as the "Lessor" (which expression shall, unless repugnant to the context or meaning thereof, include her heirs, legal representatives, administrators, and assigns) of the First Part,
AND
The Lessee, residing at __________, hereinafter referred to as the "Lessee" (which expression shall include his heirs, legal representatives, administrators, and permitted assigns) of the Second Part.
WHEREAS:
1. The Lessee has requested to take on lease a shop / commercial situated at __________, for the residential use of himself and his family.
2. The Lessor has agreed to lease the said shop / commercial to the Lessee for a period of 11 months, commencing on 28 July 2026, under the terms and conditions set forth herein.
1. Lease Duration and Rent:
The Lessor agrees to lease the aforementioned shop / commercial to the Lessee for a period of 11 months, commencing on 28 July 2026, at a monthly rent of ₹__________.
2. Payment Terms:
The monthly rent shall be paid by the Lessee to the Lessor on or before the 5th day of each English calendar month, by Bank transfer.
3. Electricity Charges:
The Lessee shall bear all electricity charges incurred during the lease period and shall ensure timely payment without default.
4. Maintenance:
The Lessee shall maintain all electrical, plumbing, and sanitary fittings in proper working condition. Society/maintenance charges shall be borne by the Lessee.
5. Security Deposit:
The Lessee has paid to the Lessor an interest-free refundable security deposit of ₹__________, refundable within 30 days of vacating the said premises, subject to deductions for damages (if any) and outstanding dues.
6. Lock-in and Notice:
The tenancy shall have a lock-in period of 6 months. Thereafter, either party may terminate this Agreement by serving 30 days' prior written notice in writing.
7. Furnishing and Parking:
The said premises are let out on a semi-furnished basis.
8. Use of Premises:
The Tenant shall use the said premises only for the purpose stated above and shall not use it for any unlawful, immoral, or hazardous activity.
9. Subletting:
The Tenant shall not sublet, assign, or part with possession of the said premises or any part thereof without the prior written consent of the Landlord.
10. Alterations:
The Tenant shall not make any structural additions or alterations to the said premises without the prior written consent of the Landlord.
11. Maintenance & Repairs:
Day-to-day minor repairs shall be carried out by the Tenant at their own cost. Major structural repairs shall be the responsibility of the Landlord.
12. Utilities:
Charges for electricity, water, and other utilities shall be borne as specified above. The Tenant shall pay all such bills promptly during the tenancy.
13. Termination & Lock-In:
Either party may terminate this Agreement by giving prior written notice as specified above. Neither party shall terminate before the lock-in period without paying rent for the balance of that period.
14. Right of Inspection:
The Landlord or their authorised representative shall be entitled to inspect the said premises at a mutually convenient time with reasonable prior notice.
15. Quiet Enjoyment:
Upon paying rent and observing the terms of this Agreement, the Tenant shall peacefully and quietly hold and enjoy the said premises during the term.
16. Registration & Stamp Duty:
Stamp duty and registration charges (if any) in respect of this Agreement shall be borne by the Tenant unless otherwise agreed in writing.
17. Dispute Resolution & Jurisdiction:
This Agreement shall be governed by the laws of India, and any dispute arising hereunder shall be subject to the exclusive jurisdiction of the courts at the city named above.
18. Renewal:
This Agreement may be renewed for a further term on mutually agreed terms, with the monthly rent enhanced by the escalation percentage stated above at each renewal.
19. Jurisdiction:
Courts at the city of execution shall have exclusive jurisdiction over any dispute arising out of this Agreement.
